ESTATE LAW

The attorneys of Mewborn Law Office understand the need to prepare yourself and family members in the case of illness, incapacity, or even death. We are sensitive to the fact that many clients find it difficult to discuss or plan for these circumstances. However, decisions that have to be made when a parent or family member is being kept alive by artificial means are much more difficult. Likewise, a plan for the distribution of property, money, and the guardianship or care of minor children upon one’s death ensures that your desires are carried out and makes an easier transition for the loved ones you leave behind. The areas of estate law that Mewborn Law Office specifically addresses include:

  • Wills
  • Living Wills
  • Powers of Attorney
  • Health Care Power of Attorney

Wills and Estates

This area of law deals with the passing of property from one generation to the next. Our attorneys listen to you and advise on how to best plan for your family’s future. This often involves planning through the use of trusts to hold property for the benefit of a spouse or minor child. In addition, we are often asked to assist in the process of the administration of the estate upon death. This involves the appointment of a representative of the estate, filing of accounts with the court, and the accounting of funds and property. We discuss with our clients their needs and desires to be addressed within their Last Wills and Testaments and are often asked to update the Wills as time passes to reflect changes in family situations or financial and property holdings.

In addition, at your request, our attorneys can draft a Living Will which sets forth a client’s desires concerning the administration of extraordinary means of life support in the event of a terminal or incurable illness. This document is very helpful to the family and loved ones of the ill, injured, or infirm, and clearly communicates the wishes of the client.

Powers of Attorney

Mewborn Law Office offers a variety of Powers of Attorney to meet the needs of their clients. Often in our military community, a General Power of Attorney is needed by our servicemen and women who deploy around the world. This document allows a spouse, loved one, or trusted friend to take care of their affairs while the service member is deployed. General Powers of Attorney are also granted by aging parents to their children, so that they can assist or manage the parents’ personal, monetary, or business affairs in their later years when they may not be able to make these decisions for themselves.

Likewise, a Healthcare Power of Attorney allows a named healtchare agent to make health decisions for the person in cases when he or she becomes incapacitated or is unable to make healthcare decisions for themselves. A Health Care Power of Attorney also allows you to make decisions regarding organ donations and the dispostion of remains upon death.
